Terms and Conditions

These terms govern the use of Portalic. By contracting for the service, you accept what follows. They are written to be understood by someone who runs a restaurant, not by a lawyer: if anything is unclear, write to us and we will clarify it.

1. Who provides the service

Portalic is a software service operated from the Argentine Republic. You contract with the party that operates it, and it is to that same channel that you address any claim or notice.

The official contact channel, and the one that is valid for any claim, notice or exercise of the rights described below, is hola@portalic.app. You can also write to us on WhatsApp using the contact button on portalic.app. We respond on business days.

If you need the full details of the party that provides the service — the name, the CUIT (Argentine tax identification number) and the legal address (domicilio), for example for an invoice or a formal claim — request them at hola@portalic.app and we will provide them to you.

2. What Portalic is (and what it is not)

Portalic is a subscription to a read-only digital menu that is reached by scanning a QR code. Its purpose is for a customer who is already at your restaurant and had a good experience to leave a Google review and follow you on Instagram or TikTok. The menu is the hook; the reviews and the followers are the product.

To leave no doubt as to its scope, Portalic does not include any of the following functions:

  • No orders are taken and there is no shopping cart.
  • Your customers never pay through Portalic: they keep paying you, as always.
  • It is not a delivery platform or a marketplace.
  • It does not manage reservations, tables, kitchen or invoicing.
  • It does not connect to the Google Business Profile API, the Instagram API or the TikTok API. You paste the review link yourself, and you upload the photos and videos yourself.

3. Your account

One account corresponds to one restaurant with one menu and one location. We do not offer additional users or profiles with different permissions within the same account.

You are responsible for your password and for everything done from your account. If you believe someone else has accessed it, write to us and change your password from the dashboard.

4. Support access to your dashboard

Portalic support may enter your dashboard to help you with a problem or to load content that you asked us to load (for example, your complete menu when you are getting started). It is a limited session: it lasts a maximum of two hours, it is restricted to your restaurant, and each access is recorded with who entered, which account, and when.

Within that session, support can view and edit the same things you can in the menu: products, categories, banners, photos and videos, the brand, the QR, and the review and social media settings.

What support cannot do, because the server rejects it: cancel or reactivate your subscription, take out a new one, change the payment method, or change your password. Decisions about your account and your subscription are always yours.

5. Price and billing

Portalic is charged as a monthly subscription. In Argentina it is charged in Argentine pesos, through MercadoPago. In all other countries it is charged in United States dollars, through Lemon Squeezy, which acts as the Merchant of Record for the sale: it processes the payment, issues the receipt and collects the taxes applicable in your country, which are added to the price. The current amount is shown on portalic.app and at checkout before you pay. We deliberately do not repeat it here: the price is managed from the platform, and a figure written in this document would become outdated without anyone noticing.

If a promotional price is in effect when you subscribe (this is only possible in Argentina), it applies during an initial period and, when that period ends, the subscription automatically moves to the full price. Both amounts and the length of the promotional period are shown before you subscribe. It is important that you keep this in mind: it is a real and planned increase in the monthly charge, which you accept when you subscribe.

The subscription renews automatically every month until you cancel it.

6. Price changes

If we change the price of Portalic, the change applies to new subscriptions and to the full price to which promotions that have not yet ended will move. It does not, by itself, modify what we are already charging you.

In Argentina, changing the amount of a subscription that is already in progress requires an explicit action on our part, which is recorded, and MercadoPago notifies the payer by email. We will inform you in advance. You do not need to re-enter your card or authorize anything again.

Outside Argentina, we do not change the amount of a subscription in progress: a price change applies only to new subscriptions.

7. Cancellation

You can cancel whenever you wish from Settings in your dashboard, without calling anyone and without explaining why. There is no minimum commitment period and no cancellation fee.

Canceling does not turn off your menu at that moment: you keep the service until the date through which you had already paid. If you cancel in the middle of the month, your menu remains live until the end of the period you have already paid for, and only then does it stop being available. We do not refund the prorated portion of that period, because you continue to use it.

A canceled subscription cannot be reactivated: MercadoPago does not allow a terminated subscription to be reversed, and so that the rule is the same in every country, we do not reactivate it when you pay with Lemon Squeezy either. If you want to come back, you take out a new subscription from your dashboard, at the price in effect at that time.

In Argentina, if the payment fails (for example, the card expires or has insufficient funds), MercadoPago pauses the subscription. In that case the paid period has already expired, so the menu stops being available until you bring the payment up to date.

Outside Argentina, if the payment fails, Lemon Squeezy retries it for about two weeks and your menu remains live in the meantime. If none of the retries succeeds, the subscription becomes unpaid and the menu stops being available until you add a new card from Settings in your dashboard.

8. Withdrawal button (botón de arrepentimiento)

If you contracted for Portalic at a distance, you have the right to withdraw within 10 calendar days counted from the date of contracting, at no cost and without having to give any explanation (Article 34 of Law 24,240 — Ley 24.240, the Consumer Protection Law — and Resolution 424/2020 of the Secretariat of Domestic Trade, Secretaría de Comercio Interior).

To exercise it you have two options, and either one is sufficient:

  • From your dashboard: go to Settings and cancel the subscription.
  • By email: write to us at hola@portalic.app from the address you registered with, stating that you wish to exercise the right of withdrawal (derecho de arrepentimiento). If you cannot access the dashboard, this option is sufficient.

Once the right has been exercised within that period, we will refund whatever you have paid, through the same means with which you paid and at no charge to you.

9. Your content

The menu, the logo, the colors, the photos and the videos you upload remain yours. We obtain only the permission necessary to host them and display them on your public menu while you use the service, which is exactly what you uploaded them for.

By uploading an image or a video, you declare that you hold the rights to do so, including the consent of any identifiable person who appears in the material. This matters especially with stories: they are photos and videos of your customers, and the consent of those people is your responsibility, not ours.

That content is published on your menu, which is public by definition: anyone who scans your QR or has the link can see it.

10. Google reviews: your responsibility

Portalic invites your customers to leave a review and opens the link to your Google listing. Complying with Google's review policies is your responsibility as the holder of that listing.

There is an advanced option you should know about before using it: Portalic allows you to hide the review button from those who rate below the threshold you choose. It comes disabled, and the dashboard shows you a warning and asks for your explicit confirmation before allowing you to enable it, because filtering who may leave a review is a practice that Google's policies prohibit and may penalize. Enabling it is your decision, and its consequences are your responsibility.

The 1-to-5-star rating that your customer leaves within Portalic is private, it is yours, and it is not a Google review, nor is it published anywhere.

11. WhatsApp coupons

If you enable WhatsApp capture, your menu offers a coupon in exchange for the customer's WhatsApp number. The coupon is sent only once, via WhatsApp, from Portalic's number, at the moment the customer requests it. Portalic does not send bulk or scheduled messages to those contacts.

You define the benefit you promise in the coupon, and you honor it on your premises. To enable capture you must verify your own WhatsApp number, and that is the number at which we notify you each time someone leaves theirs.

The contacts you collect are your database: you can view it and export it from the dashboard. What you do with it — messaging them, inviting them, stopping messaging them when they ask you to — is your responsibility and is subject to the WhatsApp rules and the data protection regulations that apply to you as the owner of that database.

12. Service availability

We do what is reasonable to keep Portalic available, but we do not offer a service level agreement or guarantee an availability percentage. There may be interruptions due to maintenance, due to failures on our part, or due to failures of the third-party services on which we depend.

We may change or discontinue features of the service. If a change affects you significantly, we will notify you in advance.

13. Suspension

We may suspend a menu that contains illegal content, that infringes the rights of third parties, or that is used abusively. When that happens, we notify you at your account's email address.

Non-payment also takes the menu offline, but only once the period you had already paid for has ended, as explained above.

14. Liability

Portalic is a tool. We do not guarantee any number of reviews, followers or customers: that depends on your restaurant, your service and your customers.

The metrics we show you are clicks and visits that occur within our own pages. They are not attributed reviews or followers: we do not read your Google rating or your follower count, and you will never see a number in Portalic presented as if it were one.

To the extent permitted by law, our liability to you is limited to the amount you have paid us in the last twelve months. Nothing in this limits the rights to which you are entitled as a consumer if the law recognizes them as non-waivable.

15. Personal data

How we process data — yours and that of anyone who scans your menu — is explained in the Privacy Policy. It is worth reading: the most important point is that whoever scans the QR is not identified in any way, unless that person decides to leave you their details so that you can contact them or to receive a coupon.

16. Governing law and jurisdiction

These terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the competent ordinary courts of the Argentine Republic, without prejudice to the venues (fueros) that consumer protection regulations grant you.

17. Effectiveness and amendments

The date of the last update appears at the very top. We may amend these terms; when we do, we will update that date and, if the change is material, we will notify you by email at your account's address before it takes effect.

If you do not agree with a change, you can cancel the subscription as explained above.
